These Terms of Service ("Terms") govern your access to and use of PartnerWithDAC.com (the "Site"), operated by Little Birdeez LLC, doing business as "Partner with DAC" ("Partner with DAC," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

What this Site is. Partner with DAC is an independent marketing site. We are not a lender, bank, or financial institution, and we do not make funding decisions. We help connect interested business owners with David Allen Capital, Inc. ("David Allen Capital") and its related funding and partner programs. Any funding, partnership, or other agreement you enter into is between you and David Allen Capital (or the applicable third party), not with us.
1. Eligibility
You must be at least 18 years old to use the Site. If you use the Site on behalf of a business, you represent that you are authorized to act on that business's behalf.
2. Our Services
The Site allows you to submit your contact and business information so that we, and/or David Allen Capital, can follow up with you about business capital products and/or partner opportunities. We do not guarantee that you will be approved for funding, accepted into any partner program, or that any particular outcome will result from submitting your information. All decisions regarding funding, approval, rates, and terms are made solely by David Allen Capital or the relevant third-party provider, in its sole discretion.
3. Electronic Communications; SMS and Email
By submitting your information through the Site, you consent to receive electronic communications from us and, where applicable, from David Allen Capital, including emails, phone calls, and text messages, at the contact information you provide. You may opt out of text messages at any time by replying "STOP," and out of marketing emails using the unsubscribe link provided. Message and data rates may apply. 4. Accuracy of Information
You agree to provide accurate, current, and complete information when using the Site, and not to submit information on behalf of another person or business without their authorization.
5. Prohibited Conduct
When using the Site, you agree not to:
Violate any applicable law or third-party right; Submit false, misleading, or fraudulent information; Impersonate any person or entity, or misrepresent your affiliation with any person or entity; Attempt to gain unauthorized access to the Site, its systems, or related networks; Use any automated means (bots, scrapers, etc.) to access or extract data from the Site without our prior written consent; Interfere with or disrupt the operation of the Site; Use the Site for any unlawful or unauthorized purpose.
6. Intellectual Property
The Site and its content, including text, graphics, logos, and design (the "Content"), are owned by or licensed to Little Birdeez LLC and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own personal or business informational purposes. You may not copy, reproduce, distribute, modify, or create derivative works from the Content without our prior written consent.
7. Third-Party Content and Services
The Site may reference, link to, or direct you toward third-party websites and services, including David Allen Capital's website and application portals. We do not control and are not responsible for the content, products, services, or privacy practices of any third party. Your interactions with David Allen Capital or any other third party are solely between you and that party, and are governed by that party's own terms and policies.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SUBMITTING YOUR INFORMATION WILL RESULT IN FUNDING, APPROVAL, OR ANY PARTICULAR OUTCOME. WE DO NOT CONTROL AND ARE NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF DAVID ALLEN CAPITAL OR ANY OTHER THIRD PARTY.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LITTLE BIRDEEZ LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY DEALINGS WITH DAVID ALLEN CAPITAL OR ANY OTHER THIRD PARTY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless Little Birdeez LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state or federal courts located in Sacramento County, California, and you consent to personal jurisdiction there. Before filing a claim, you agree to first contact us at [email protected] so we can attempt to resolve the dispute informally.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Severability; Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Little Birdeez LLC regarding the Site.
